The rest of the 06-01-12 Agreement

Camps/Patton State Hospital: for the purposes of both the Statewide Bid as well as layoff, camp employees shall be tied to the following hiring authority institutions (as opposed to the county in which the camps are physically located): CCC, CIW and SCC. Patton State Hospital shall be tied to CRC.
Wave 2 Statewide Bid Process (paragraph 17 for Wave 1):

(1) Same

(2) All staff, including Correctional Officers, Correctional Counselors, Fire Captains and Parole Agents, at overage institutions or in overage counties for DAPO, as determined by CDCR may participate in the Statewide Bid Process to bid on identified Permanent Full-time vacancies and PICO positions within the State.

(2) Where there are overage institutions or overage counties, only the number of people that comprise the overage will be permitted to leave the institution/county. For example, if an institution needs to shed 10 people, the 10 most senior people who are successful in the Statewide Bid will be permitted to leave (even if 50 people put in requests).

(2b) Transitional Academies:

Correctional counselors with Correctional Officer in their background who presently work in an institution do not need to attend a transitional academy.
Fire Captains and Correctional Counselors with Correctional officer in their background who do not presently work in an institution, but who have been a Correctional Officer within the last 36 months, do not need to attend a t transitional academy.



Correctional Counselors with Correctional Officer in their background who do not presently work in an institution and who have not been Correctional Officer in the last 36 months will attend a 2-week transitional academy.
Parole Agents with Correctional Officer in their background will attend a 2-week transitional academy.


Fire Captains with Correctional Officer in their background, but who have not served in the Correctional Officer classification for 36 months, will attend a 2-week transitional academy.


Unit 6 Peace Officer classifications without Correctional Officer in their background will attend a 5 to 8 week transitional academy. The curriculum will be provided to CCPOA once it is finalized. If staff do not pass the Academy, they must be laid off and will be informed of this fact both in their Bid Worksheet and in their SWB award letter.


(2c) Parole Agents will be allowed to participate in the SWB and released to their awarded institutions based upon parolee population and caseload reductions. In some circumstances, Parole Agents will be in effect “reserving” their position at an institution. If there are two agents in the same county and one is to be released first, the most senior Parole Agent shall have the option of reporting to DAI first. As such, the principle of seniority is honored.

(5) CDCR shall calculate the transfer awards and communicate a start date with at least fourteen (14) days’ notice. After receiving a transfer date, and employee may be granted a change in the report date by agreement of the releasing worksite and the receiving worksite.
SORA/LAYOFF PROCESS (paragraph 189)


(1) Those that have not been able to mitigate layoff through the StateWide bid shall proceed with the SROA/layoff process.


(2-8) Same


Paragraph 19: Meet and Confer after Completion of Second Wave: In an effort to foster partnership and communication between the parties, and with an eye toward improving the various opportunities described above, the parties shall meet and confer in good faith regarding these opportunities and processes after the conclusion of the Second Wave.

Paragraph 22: Per Diem-2nd & Subsequent Wave


All unit 6 Peace Officer Classification shall receive Per Diem consistent with our Realignment Side Letter Agreement for Wave 2 and Subsequent Waves, which is either $125 for 30 days for PBSP, HDSP and CCC or $85 for 30 days for all other transfers. In each instance, the transfer must be over 50 miles from the employee’s current work location to his/her new work location in order to be eligible for Per Diem.

Staff will be paid ½ of Per Diem prior to transferring to their new location and the other ½ will be paid during their first week of physically working (not using leave credits) at their new institution. If an employee fails to meet these requirements of receiving Per Diem, he or she will be required to return immediately any Per Diem that has been paid. Employees who have suffered unforeseen or extenuation circumstances that preclude them from meeting their reporting requirement may be reviewed jointly by the Assistant Secretary of Laver, or designee, and CCPOA’s Executive Vice President, or designee, upon CCPOA’s request.


Just like in Wave 1, Per Diem will NOT be paid for any final, limited PICO transfer opportunity (previously referred to as 4a in Wave 1), if in fact such a final opportunity if offered.

OTAPs/PICOs


The wave 2 PICO numbers do not incorporate anticipated attrition between now and when people are laid off on October 20, 2012. As a result, between the SEB and the layoff, people will leave the department and create vacancies. The vacancies created by attrition from now through mid-July will be available for PICOs (and remaining OTAPs) to roll up to PFT. In mid-July, however, we will have to freeze that process in order to identify the number of vacancies available for purposes of layoff options in impacted counties. After that, some vacancies may be available via SROA and/ or a final PICO opportunity if one is offered.


Follow-up Meetings: The parties recognize that this process is fluid and not all circumstances can be anticipated or addressed in this addendum. The parties, therefore, agree to continue to meet on at least a bi-weekly basis during Wave 2 to explore and seek to resolve issues and unforeseen circumstances. It is the intent of the parties that these meetings will have limited number of attendees and will be guided by an agenda prepared and shared in advance.

As of July 2, 2012, a number of institutions (and counties for DAPO) are to be in overage status. Rather than temporarily, Involuntarily reassigning more of the overage people in 30 work day increments pursuant to section 12.03, the parties agree that employees can be temporarily involuntarily reassigned for up to sixty (6) calendar days while receiving contractual short term per diem. In all other respects, 12.03 remains unchanged. Prior to temporarily, involuntarily reassigning employees, the State will first seek volunteers.

The parties further agree that they will meet during the first two weeks of June to discuss how employees from overage institutions will be moved to fill needs at institutions with vacancies.

Employees may also submit a hardship exception from involuntary reassignment to the Assistant Secretary of labor.

This agreement does not apply to DAPO office closures (subject to separate negotiations) that will result in agents ultimately being permanently transferred to different work locations.

Between July 2, 2012 and October 31, 2012, when an employee is on an intern temporary assignment pursuant to this agreement, the employee will be reimbursed for the number of miles driven in excess of
his /her normal commute (roundtrip) once every two weeks during the temporary assignment.

CCPOA and CDCR agree to continue with the job exchange program as outlined in the proposal of April 19, 2012 with details to be worked out before the conclusion of wave 2."

Does this mean there will be attempt by ccpoa and administration to roll over picos to full time position in the first two weeks of July?

should be SWB not SEB, "StateWide Bid"....I read it the way you do. You just never know for sure with the state.

The only reason why the academy should be "re-opening" will be for the Transitional Academy. Parole Agents will have to attend for 2 weeks.

I'm confused?? Are parole agents bidding on open co spots throughout the state....?? Are they staying only in there county and if they can't get a job in there county are they going to be laid off...or they going to be able to bid anywhere in the state? Another question.......what jobs are going to be up for bid for co s.....??pico jobs? I work at pelican bay and we are fully staffed minus a couple retires.....

Looks that way because in paragraph 17 2b it talks about transitional academies even for people that have never been a co.

Do the parole agents only get to pick from the jobs available on the state wide bid, or are they going to get the I'm special card and get to bid to any prison they want and bumb co s

"I'm special card?" Really? You do understand that we (PA's) have very little desire to go into an institution, right? Also, this is something that we did not cause. As you may or may not know, CCPOA has regularly thrown DAPO under the bus, as we are a much smaller division compared to DAI. Do you understand that there are several counties that do not have an institution. Where exactly do you think agents should demote to when they are facing layoff? Being an agent who was hired outside the department and reside in a county without an institution, there are very little options available. It must have been pure sympathy for us that the state will offer a transitional academy to those that choose to accept this option.

After all, is not BU 6 time still BU 6 time? Last time I checked, agents still pay into CCPOA. And for what, to get crapped on by Mikey and the boys!!

There is no reason to look down your nose and be disgruntled toward agents. If you were bright enough maybe you could have been one. Grow up already, damn!!!

Not to be a bad news bear to the comment above me but I was a parole agent and decided when ab109 went into effect to go back to my old joint because I saw the writing on the wall...so I'm actually just wondering what is going to happen with all parole agents......I don't look down on you but I do know all the special little perks you get that line staff don't......so before you start asking people if there bright enough I was one and just smart enough to take my masters degree back to my old joint............good luck buddy

Good question are Parole Agents allowed to bump back to any prison or the prison in their county only. C/o's were allowed only to bump in our own county.

Well, without getting into a pissing contest, good for you! I was one of the unfortunate people who bought into the whole "5 Year Road Map" and left a nice career to join DAPO. Fortunately for me, I will be able to return. Have little desire to spend half my life in an institution. There are things that are more important than a check.

Please elaborate on this "I'm special card" as I was never issued one. As for the little perks that come with an agent position - that's part of the job! If that offends people, so be it - they could have put in an application. Also, they help make up for the phone calls at all hours of the night!

As for having good luck - luck has nothing to do with anything. Everything I receive is earned. But thanks!

My apologies if I came across as a jerk. It's not uncommon, as I am sure you know, to be looked down upon by custody staff for being an agent. I have attributed it to some form of jealousy. But who knows and who cares.

BTW - your not the only one with an advanced degree, but congratulations!

I can say one thing, Parole Agents are not "scared" to be around inmates. We go into those fools homes alone with NO backup partner. Give me a fricken break. This is not the time to squabble. We all need to remember BU6 time is BU6 no matter where we are.

Just a bit of advice to all co s who are thinking about taking a transfer, think long and hard I along with many of my co workers took a transfer in the first wave to a prison so far away we don't even get to go home but once a month if were lucky......most of us were under the assumption we,d stay for a wave or two and transfer......well now we know we aren't going anywhere for a couple years at the least....the state is not letting any officer at a prison that is understaffed transfer until this is all over.....2015? 2016? I'm not telling you not to transfer but think about what it will do to your family, your kids, your marriage........in the last 7 months of transferring I've seen 2 divorcees and many kids upset because they never see there father.......just something to think about.......

To all the CO's here. I'm a PA and will not have to come back to the institutions i have worked at because i have time in (20+). Both jobs have the benefits and vice versa. I have been assaulted numerous times inside and earned my bones. CO's are a different breed then PA's. CO's have to adapt to a environment that kills you years earlier because you have to adapt and have animal mentality. PA's work excessively and have to multi task constantly and deal with Maggotts who do not listen to you and engage in criminal activity. We have no rights whatsoever because management walks on us and if you complain you are a target. I love my job because i get involved in various activities. We have some perks (State car/Larger Salary/Make my own hours) but at 20 years i never see overtime. i would be top twenty if i was back inside at my last prison.

Point in case: When you talk ill of US and are disrespectful and you have no time in you basically make us OG's want to work even longer because we are annoying the crap out of you. Annuitant, 35/40 years in! We were Guppies at one time and know what it is like to have no power and be vulnerable. So keep it up. We will just keep coming and you will just keep complaining. You may be US one day.
Just learn to pray to god you keep your job because this is only the beginning. Eventually you will have no job to complain of and no one to make idle threats at.
