UPDATE – AB 109 NEGOTIATIONS

Over the last several months, CCPOA and the state have been in negotiations regarding the impact of the AB 109 Reductions. Due to AB 109, passed by the Legislature and the “Overcrowding Order” issued by the Supreme Court, the state sent out approximately 30,000 SROA letters informing staff that they were possibly subject to layoff. In an effort to mitigate the number of CCPOA employees actually laid off, CCPOA agreed to the first Wave of four Opportunities. Through this agreement relocation opportunities throughout the state, as well as additional OTAP and PICO positions for bid by seniority, were made available to staff effected by the layoff.

As a result of staff taking the opportunities offered in this first Wave, the number of staff potentially subjected to layoff has been reduced to approximately 250 statewide. CCPOA successfully negotiated one final opportunity available to those 250 staff to retain state employment. Therefore, if all identified staff avail themselves of this final opportunity, no BU6 employee will be laid off.

To avoid a possible layoff, many BU6 employees have taken PICO and OTAP positions. This has led to a situation where an employee with 10+ years of seniority now find themselves in PICO jobs. CCPOA has always honored seniority; therefore, the negotiating team has negotiated the following: when a Permanent Full Time (PFT) position becomes available, the most senior OTAP employee will be offered the position. Then, the most senior PICO (meaning total BU6 seniority, not institutional seniority) will be offered the newly available OTAP position. This process will occur with every PFT placement as it occurs.

Prior to the AB109 Reductions, the local Chapters met with management to discuss the elimination of positions due to deactivations. However, with the advent of the AB109 reductions, many institutions refused to provide information to the chapters or in some cases refused to meet locally. The CCPOA negotiating team has negotiated a drastic change in the process.

The state is now required to provide all information which is necessary and pertinent to AB 109 Reductions. The previous “local discussions” will now be formal Meet and Confer negotiations over the impact of these deactivations, which will result in written agreements, signed by both parties. Individual files for each deactivation will be created and the negotiating authority will be delegated jointly to the assigned Field Representative and the institution’s Chapter President. The Chapter President will determine the negotiating team members. If local negotiations breakdown, the issue will be elevated to the statewide AB109 table for resolution.

The team is now in the process of addressing a layoff appeals process: to include the re-evaluation of the seniority scores for staff receiving a layoff notice, a way to allow staff who have made drastic moves to get back to their previous area of employment, and the effect recent changes have made to the Post and Bid Process.

This CCPOA statements is a complete opposite of what information was distributed on the same day:

OTAP and PIE officers were informed that after their shift that day, February 2, 2012, those positions will be placed on "vacation" to burn their remaining banked furlough hours. Once their furlough time is used, they are considered laid off.

No official word, statement, or memorandum has surfaced regarding this maneuver. It is also unknown if this is statewide or just at DVI due to the so called "over staffing" situation here at DVI.

If anyone has more valid information regarding this attack on DVI staff by the state and administration, please forward it to the rest of us that are left in the dark.

We do not want or mean to feed into speculations and rumors, but no one, I mean NO ONE, including our union has any pertinent information to share. We can only go by what was told to staff in those positions and what little information gets filtered through mid-level supervisors.

Really, has anyone informed the CCPOA local chapter president of these negotiations. He has simply been dogging the local membership with his in your face lies and give up everything actions that has been demoralizing to custody staff. In other words, DVI does not currently have competent representation and desparately need the CCPOA headquarters to step in and correct the farce that has been going on since the last local chapter union official elections. How can Mr. Jimenez sit back and allow this to go on without looking into the situation? Make you wonder if the union even care about the members at all.

How am I supposed to believe the state and/or union on this latest pronouncement when I was previously told to take a OTAP/PIE spot to mitigate being laid off. All OTAP/PIE are now laid off at DVI. Is this hate left over from Salinas's cronies in HQ? Is Jerry trying to show he is being "fair" and that he is laying off COs too? Just incompetence?

I was informed that COX was on the negation table yesterday with administration regarding the lay-off in DVI, I guess this is what he negotiated. He should have put a Memo out of the outcome of his accomplishments. Thanks COX

The funny thing that gets me, at DVI is that our last chapter president would not of gave in like our current president, hate all you want but he had administration worried cause he understood the rules and regulations. Ask yourself people would u be worried?

We need Casey back ASAP, can the men and women of DVI custody staff have a do over, seems there were mistakes made with our ballots. Some of us had no idea we were cutting our own throats, selecting a local chapter president who was never up to the task.

When Cox was campaigning he left out the fact that he wasn't qualified nor ready to represent the men and women of DVI as a CCPOA local chapter president. Especially, in the manner that each and everyone of us deserved to be represented, while paying for the privilege.

The ball was dropped the moment the votes were tallied up. When Casey was defeated we were simply betrayed by the margin of victory that truly favored DVI's snake in the grass management tactics.

It's understandable that people are upset right now. With this whole mess that is out of control. But hating on people isn't going to solve anything.

While many people have different opinions on Bob Cox, I can tell you that he is trying. He hasn't sold anybody down the river, and he is in talks with admin.

Over the years, we have had many mountains to climb, we will climb this one as well, We are not your ordinary average state workers, we are Peace Officers who can overcome.

With some faith in God, and a little luck, we'll make it through this. Stay professional, and stay strong my DVI family.

Its your union right? Time to take charge of it..

I would be asking why right now , I wold be at the desk of mike Jimenez and find out why you are at home!! And why he was/ is in Vegas again spending your union dues!!

A lot of us have been beating the bushes for 3 years only to be called all kinds of bullcrap, now it came to reality which we have been told where is the proof! Not going to the I told you so bs, you just have to act now!

Well now what are we going to do about our out of control, poo r leadership , And most of all we are paying for them to live on the high hog !

When is it time for you guys to take control or through these guys out?

Well I have no more fight in this, Ir have tried while I could as many others are still doing…. Get involved , go to sac and sit down in your bldg till you get answers!!!!

Speed dial your chapter presidents till they do there jobs and fire the EC, and most of all, Fire those useless lawyers who live in luxury because of you, while you my friends are sitting at home or one of your partners are doing the same while you sit idle and don’t give a bleep because your safe.

I once was proud to stand shoulder to shoulder with the likes of the union heads as they fought for us, now it’s all about what they can get before the house of cards hits the floor.

CIM is on the same page with DVI as it appears. According to CIM admin they are under instruction from their bosses to place everyone that is getting laid off out on leave, to burn as much time as they can before their layoff date. What ever time is left will be cashed out.
I strongly believe our union was in on the whole process. Why wasn't this presented to us when our mou was up for vote? That whole "side agreement" letter was signed by our union's powers that be. The letter specifically waived our right to collect our full due for a forced transfer and allowed the state to conduct a regional layoff even though we are a state department. Brothers and sisters we are a different breed we are a breed of people that show up everyday to a hell hole knowing that at any moment a brother or a sister will need your help and without any hesitation you place you life on the line for them. Let this not be a fight we turn away from but let this be what brings us back together. I love you guys!

Dosomethingaboutit and the CIM officer are making points that goes unheeded time an again. What will it take before we all stand together to obtain our rights from our CCPOA union leadership and CDCR management who seemed to have join forces in stripping them away? These two entities are having their way with us and we just stand by and take it when we do not have to.

I guess as along as nothing is happening to you, or you are in favor of the powers that be everything is alright for the moment. Well it is not and sooner or later the impact will catch up to us all. You may not be getting layed off or terminated. However, you should be concerned with what happens to the situation we will be working in. The danger level is rising due to the dramatic cuts in prison staffing in California. What extreme pressure pushes the majority of CCPOA members to the fed up point of enough is enough. After all the gains of the previous CCPOA administration are gone!

Hopefully our brothers and sisters are realizing those gains are being chipped away. It is time we all get on board the membership bus and steer it to champion our cause to establish our real rights, that are often played with by the powers that be.
